Legal warranty of conformity

For purchases made by consumers in Portugal, new movable goods are covered by a legal warranty of conformity for three years from the date of delivery, under the terms of Decree-Law no. 84/2021, of October 18.

As a rule, if a lack of conformity manifests within the first two years, it is presumed to have already existed at the date of delivery. In the third year, it may be necessary to demonstrate that the problem originates from a cause prior to delivery.

If the lack of conformity manifests within the first 30 days after delivery, you may request the immediate replacement of the item or the termination of the contract, in accordance with the law.

• The date you detected the problem;

• Photographs or a video, if useful to show the situation.

Repair, replacement, and other remedies

When a lack of conformity covered by the legal warranty is confirmed, the consumer may choose between repair and replacement of the item, except when one of these options is impossible or involves disproportionate costs.

The repair or replacement must be performed free of charge to the consumer, within a reasonable time and without serious inconvenience. As a rule, it should not exceed 30 days, except for the exceptions provided by law. If the solution is not possible, does not solve the problem, or if the lack of conformity recurs, other legal remedies may apply, such as a proportional price reduction or the termination of the contract.

Each repair benefits from the additional period provided by law: six months per repair, up to the legal limit of four repairs.

Situations not covered by the legal warranty

The legal warranty of conformity does not, as a rule, cover damage caused after delivery by accidents, drops, impacts, overloading, or use contrary to the care instructions. Each request will be analyzed individually. This information does not limit the consumer's legal rights.

Additional commercial warranty

If an item has an additional commercial warranty, its duration and conditions will be indicated on the product page or in the corresponding documentation. This warranty complements the legal warranty and does not replace or reduce the rights provided by law.
